What happens if you are partially to blame for the accident?
People worry that if they bear some measure of responsibility for the accident in which they were injured they won’t be able to receive the compensation they need. Fortunately, this is not true. Though you should be aware that laws on comparative fault (also known as comparative negligence) vary from one state to another, in California we abide by the principle of “pure comparative fault.”
Comparative fault means that the law recognizes that many accidents are the fault of two or more parties and therefore allows the court to assign percentages of blame to all parties. Therefore, in an accident in which you are awarded $100,000 in damages, if you’ve been assigned 10 percent of the blame, you will actually only receive $90,000.
