When Strict Liability Applies — and When It Does Not
Section 3342 only applies when the bite victim was (1) in a public place or (2) lawfully in a private place. A trespasser is not covered by strict liability — though they may still have an ordinary negligence claim against the owner. Postal workers, UPS and Amazon delivery drivers, meter readers, and invited guests in someone’s yard are all “lawfully in a private place” for purposes of the statute. A burglar climbing a fence is not.
Strict liability applies to bites only — it does not automatically apply to other injuries caused by a dog (being knocked down by a large dog, for instance). Those cases proceed under ordinary negligence principles, where California’s long-standing rule is that dog owners must exercise reasonable care to prevent their dogs from injuring others.
