California’s Strict Liability Dog Bite Law (CC §3342)
California Civil Code §3342 imposes strict liability on dog owners when their dog bites another person. This means:
- The owner is liable regardless of whether the dog has ever bitten anyone before
- The owner is liable regardless of whether the owner knew the dog was aggressive
- You do not need to prove the owner was negligent
- You only need to prove: (1) the dog bit you, (2) you were in a public place or lawfully on private property when the bite occurred
California does not follow a “one free bite” rule. The first bite triggers full liability.
When Strict Liability Applies
Strict liability under CC §3342 applies to bites specifically.
