If you are an Uber driver who has been seriously injured on the job, you need the help of an experienced Uber drivers rights lawyer to assist you. If you reside in the greater Los Angeles area the Uber accident attorneys of Compass Law Group, LLP are an excellent choice. Known for their compassion as well as for their comprehensive knowledge of California car accident law, they are fully prepared to fight vigorously to make sure that you receive the compensation you’re entitled to through agile negotiation, or if necessary, through strategic litigation.
Just as it is important to understand the full scope of your rights regarding wages and hours, unemployment insurance and other matters, it is critical to understand your rights if you suffer a serious personal injury to protect those rights and receive the compensation you deserve. You should know that we may be able to tap Uber’s extensive insurance resources whether or not you were at-fault in the accident.
Our attorneys know all too well how insurance companies, not to mention employers, often try to take advantage of drivers by getting them to agree to settlements that are far too low to cover all of their current and future expenses of the accident. At Compass Law, we are committed to leveling the playing field, leveraging our legal background to get you every dollar you deserve.
Understand Your Rights with Compass Law
At Compass Law Group, we are well aware that being an Uber driver has its complications, especially if you have been injured in a car accident. Now that Uber drivers are considered employees rather than independent contractors under California state law AB-5, there are some substantive changes in your rights as an Uber worker.
California Auto Insurance Requirements for Rideshare Drivers
As an Uber driver in California, you are covered by rideshare insurance any time your rideshare app is on. Minimum auto insurance requirements vary according to which “period” you are in relative to work activity:
Period 0: When your rideshare app is off, your personal insurance is active, which should meet California’s minimum auto insurance requirements of:
- $15,000 bodily injury coverage per person injured in an accident
- $30,000 of bodily injury coverage per accident
- $5,000 of property damage coverage per accident.
Period 1: If the rideshare app is on but you haven’t been paired with a passenger, California law has the following minimum requirements.
- $50,000 bodily injury liability coverage per person injured in an accident
- $100,000 of bodily injury liability coverage per accident
- $30,000 of property damage liability coverage per accident
These requirements can be met by your personal rideshare insurance policy or one provided by your Transportation Network Company (TNC) if it offers this coverage. Uber provides this liability insurance for drivers during Period 1 if they don’t have their own rideshare policy. Your TNC is also required to provide at least $200,000 of excess liability insurance coverage.
Periods 2 and 3: Once you’ve been paired with a passenger and they have entered your vehicle, Uber is required to carry a $1 million liability insurance policy in California. This covers you and your passengers during Periods 2 and 3. Your TNC may offer additional coverage during these periods as well.
It is reassuring to know that Uber provides its drivers with $1 million of uninsured and underinsured motorist bodily injury coverage, as well as comprehensive and collision coverage with a $1,000 deductible so long as the driver also has collision coverage on his or her personal auto insurance policy.
Who will pay if you are seriously injured due to someone else’s negligence?
Although the $1 million policy Uber carries may seem like an enormous amount, if you become permanently disabled, it is unlikely to cover the years of care you require, especially considering that you have almost certainly lost your ability to earn.
Whether or not you are driving under the auspices of Uber at the time you are hurt, if another driver has caused you severe personal harm, such as compound fracture, a spinal cord or traumatic brain injury, or a serious burn, Compass Law may also be able to file a successful lawsuit on your behalf against the at-fault driver.
Moreover, depending on circumstances, we may be able to sue a manufacturer for selling you a defective car part or the city for failing to repair an egregious pothole. Whatever happens, our Uber accident attorneys will have your back. Realizing as we do that you are under financial, as well as physical and emotional stress as you recover from your ordeal, we will charge you no attorneys’ fees until we win your case.

Damages Compass Law May Be Able to Win for Uber Drivers
You may be wondering what types of damages you may obtain through our careful negotiations with Uber’s insurer and the at-fault party’s insurance company. Though each case is different, depending on the nature of your injury, we may be able to win you damages to cover:

- Pain and suffering
