What is a negligent security claim?

California property owners have a duty to take reasonable steps to protect people on their premises from foreseeable harm, including criminal acts (Civil Code § 1714). When an owner ignores a known risk — prior assaults, broken locks, no lighting, absent security — and an assault results, the owner can be liable for negligent security.

What must be proven?

A negligent security case generally requires showing the owner owed a duty, the assault was foreseeable (often from prior similar incidents), the owner failed to provide reasonable security, and that failure was a substantial factor in causing the harm.
