Can an intoxicated person legally consent?

Consent must be freely and knowingly given. When a person is incapacitated — unconscious, or so impaired by alcohol or drugs that they cannot understand the nature of the act — they cannot give valid consent. Sexual contact in that situation can support a civil claim for sexual battery and, where applicable, sexual assault.

What if I was drinking and did not fight back?
